Authorized Fundraiser Policy
Effective Date: September 23, 2021
By purchasing Products from JP John Paul for the purpose of fundraising-related resale within the United States, you agree to the terms described in this Authorized Fundraiser Policy (“Fundraiser Policy”).
You may:
- Sell Products solely for fundraising purposes to end-use customers, who must be the final purchasers and ultimate consumers of the Product.
- Make sales only through the official fundraising channels provided or authorized by JP John Paul.
You may not:
- Sell or transfer Products to any individual or entity that you know, or have reason to believe, intends to resell the Products.
- Sell or transfer quantities of Products that exceed what is normally purchased for personal or fundraising use.
- Ship, promote, or distribute the Products outside the United States of America.
- List, offer, or sell the Products on any third-party website, online marketplace, mobile app, or digital platform (including but not limited to Amazon, eBay, Walmart Marketplace, or similar services), except for fundraising platforms expressly approved by JP John Paul.
You agree to:
- Conduct your fundraising efforts in a reasonable and ethical manner at all times and not make any warranties or representations concerning the Products except as authorized by JP John Paul.
- Comply with any and all applicable laws, rules, regulations, and policies related to the advertising, fundraising, sale, and marketing of the Products.
- Represent the Products in a professional manner and refrain from any conduct that is or could be detrimental to the reputation of JP John Paul or the Products.
- Exercise due care in storing and handling the Products and strictly follow all instructions provided by JP John Paul regarding storage, handling, shipping, disposal, and any other aspect of the Products, including instructions provided on Product labels.
- Not remove, translate, or modify any label or literature on or accompanying the Products.
- Sell Products only in their original packaging. Relabeling, repackaging (including separating bundled Products or the bundling of Products), or making other alterations to Products or their packaging is strictly prohibited.
- Not tamper with, deface, or otherwise alter any identifying information on the Products or their packaging.
- Inspect the Products and their packaging for damage, defects, broken seals, evidence of tampering, or other nonconformance immediately upon receipt. If any issues are identified, you agree not to sell the affected Product and must promptly report the issue to JP John Paul.
- Deliver the Products to the final purchaser within 30 days of receipt.
- Not sell any Products after the expiration of the shelf-life date or if they are damaged or deteriorated in any way.
- Cooperate fully with JP John Paul regarding any Product recall, consumer safety information requests, complaints, or adverse claims involving the Products, and assist in any investigation or resolution process.
Intellectual Property
You acknowledge that JP John Paul or its licensors own all proprietary rights in and to the intellectual property related to the Products (“JP John Paul IP”).
You are granted a limited, non-exclusive, non-transferable, revocable license to use the JP John Paul IP solely for the purpose of marketing and selling the Products for fundraising, as outlined in these Terms.All goodwill arising from your use of the JP John Paul IP shall exclusively benefit JP John Paul or its licensors.
JP John Paul reserves the right, at its sole discretion, to review and approve—or revoke—your use of its IP at any time, without limitation.
